TERMS AND CONDITIONS FOR PHOTO SESSION BOOKINGS

DEPOSIT: A Deposit of 30% of the total session fee is required to reserve a photo session. If makeup is included a deposit of 50% of the total fees is required for all advance bookings. If there is no cancellation or postponement, the deposit will be applied towards the total session fees.

CANCELLATION POLICY: By making payment of your deposit you acknowledge that in the case of cancellation: If cancelled with 60+ days notice, we will refund your deposit, less a $50 service and handling fee. If cancelled between 15 and 60 days of your booking date, you will be charged a cancellation fee of 50% of the deposit. If cancelled between 3 and 14 days of your booking date, you will be charged a cancellation fee of 75% of the deposit. If cancelled within 48 hours of your booking date and time, the deposit is 100% non-refundable.

POSTPONEMENTS: Postponements may result in loss of deposit per the Cancellation Policy, or a re-booking fee dependent on the date of notification, the reason, and if we have turned down bookings for the date and time and are unable to secure new bookings within the time frame. This will be totally at the studios discretion.

AVAILABILITY AND BOOKINGS: Availability is not guaranteed without an acceptance of the terms and conditions of this agreement and our receipt of your deposit.

WARDROBE: Colorado Boudoir does have very limited wardrobe items available, however we cannot provide items in all sizes, colors, styles etc. Therefore, the Client is responsible for their own wardrobe and any props needed unless other arrangements have been made.

COPYRIGHTS AND USAGES AND RIGHTS TO IMAGES: Colorado Boudoir retains the rights to use the best client photos as portfolio samples for publication on their promotional website(s) or in their advertising. We always want to show off work that we are proud of and our portfolios are our advertising. We never will put photos in our public portfolio that we feel would compromise our client's reputations. We do understand that some clients may not want any of their photos that we create to be made public in any way. We have no problem with this, and for those clients who do not want us to use any of their photos in our portfolio we require that they sign the photo release with the box checked saying they do not wish their photos to be shown publicaly.

LIFE OF ONLINE GALLERIES, SESSION PURCHASE CREDITS, AND PRICING: Online Galleries, including any Coupons, or Credits and pricing structure will remain online and available for 90 days. Coupons are only good for 90 days unless they specifically say otherwise. After 90 days Online Galleries are removed and archived. To reinstate the Online Galleries for an additional 90 days there may be a re-activation fee that is applicable to print or retouching purchases. Print and Product Prices may change at any time without prior notice.

LIABILITY: Colorado Boudoir and/or their employees will make every effort to produce the finest quality images possible, however, client agrees to hold harmless from all liability connected with the photography session, makeup or hairstyle services or loss of the images for what ever reason. In the case of a computer failure or other cause, including negligence, or unauthorized access of the online galleries, server failure or any situation that results in the loss or compromise of all or a portion of the photos, or the unauthorized use of the photos by a third party, damages are limited to the original cost of services or a proportional part of the session's advertised total output.

SUBSTITUTION: In the case of an emergency that would make it impossible for Colorado Boudoir to perform the services on the day of the session, the client may choose to request all deposits be refunded, or when possible allow for Colorado Boudoir to provide a qualified substitute photographer as replacement, or reschedule for another date.
